By creating an account, selecting “I agree,” or using 3 Breaths, you agree to these Terms and Conditions. If you do not agree, do not use the app.
Your privacy, consent, and sense of safety matter to us. These Terms explain what you can expect from 3 Breaths and what we ask of everyone who uses it.
3 Breaths is a connection and wellbeing app that allows users to signal availability, match with another person, and share a short breathing or connection ritual.
3 Breaths is not therapy, medical care, mental health treatment, crisis support, coaching advice, religious guidance, or emergency response. You use the app voluntarily and at your own discretion.
You must be at least 18 years old to use 3 Breaths.
You may not use the app if you have been suspended or banned unless we give you written permission. You agree to provide accurate account information and not impersonate another person.
3 Breaths exists to create brief, respectful human connection. You agree to treat other users with consent, care, and basic decency.
You may not use 3 Breaths to:
Either user may end a live interaction at any time for any reason.
Every user may flag another user after an interaction.
Flag categories may include:
A flag does not automatically mean someone violated these Terms. It gives 3 Breaths the right to review the situation and take action.
Users may also block other users. Blocking means we will try to prevent future matching between those users. Blocking is private, and the blocked user may not receive a detailed explanation.
3 Breaths may take any safety or moderation action we consider appropriate, including:
Repeated credible flags may lead to warning, suspension, or permanent ban. Serious violations may result in immediate suspension or permanent ban without warning.
False, malicious, or abusive reporting may also lead to action against the person making the report. We are not required to disclose the details of moderation decisions if doing so could affect user privacy, safety, or platform integrity.
3 Breaths is not an emergency service. If you believe you or someone else is in immediate danger, contact local emergency services.
If a user expresses self-harm, suicide, violence, abuse, or immediate danger, 3 Breaths may take safety action, including restricting the account, preserving relevant information, or taking other steps we believe are appropriate.
Do not rely on 3 Breaths to monitor, respond to, or resolve emergencies.
You are responsible for anything you submit to the app, including your name, photo, profile information, comments, reports, feedback, and other content. You must not upload content that you do not have the right to use.
You choose whether to provide optional feedback and whether to share a reflection publicly. Content clearly marked as public may appear to members of the relevant community. Reports, private comments, and other content marked as non-public will not appear in the public community feed, although authorized administrators and team members may review it when needed to operate, protect, or support the app.
You give 3 Breaths permission to store, process, review, moderate, and, where you have chosen to make it public, display your content as reasonably needed to operate, improve, protect, and support the app.
If you separately choose to include a specific reflection in the Open Heart Collage, you give 3 Breaths permission to preserve an approved Collage copy of that reflection and display it, with the first name and profile image covered by that permission, to members of the community you selected. This permission is voluntary and is not created merely by accepting these Terms.
Leaving or being removed from a community does not by itself withdraw a separate Open Heart Collage permission. Before account deletion, we will offer a clear choice to remove your Collage copies or ask us to preserve the copies you previously approved. If you choose preservation, the permission may continue after account closure, but you may still withdraw it or request deletion through Settings while signed in or by contacting us afterward. When we honor a withdrawal or deletion request, we will stop future display and delete or de-identify the retained Collage copy as required by law. Withdrawal does not affect display that was lawful before withdrawal.
Deleting a source reflection is treated as a request to remove it from the Open Heart Collage. Permission for an in-app community Collage does not authorize use on public signup or login pages, advertising, press, or social media; those uses require a separate permission, such as an applicable PR Champion permission.
3 Breaths may offer optional recording features, including solo video testimonials and live sessions where both participants have given recording permission. We will show recording status in the app when an app-controlled recording is active.
If you choose to record a video testimonial, you give 3 Breaths permission to use that testimonial, including your image, voice, name, words, feedback, and related breath metadata, for any lawful business, promotional, educational, product, safety, or community purpose. This permission includes storing, editing, reproducing, publishing, displaying, distributing, and promoting the testimonial in any media or channel.
If you give permission for recorded sessions, and the other participant has also given permission, 3 Breaths may record the session and use the recording and related metadata for any lawful business, promotional, educational, product, safety, or community purpose. If either participant has not given the required permission, the session will not be recorded by 3 Breaths. You may turn off your session-recording permission in Settings at any time for future sessions.
If you opt in as a PR Champion, you also give 3 Breaths permission to use your first name, image, voice, and any text or video reflections you choose to share in public 3 Breaths stories and promotion. We may create a still portrait from a recording you have consented to share. Turning PR Champion permission off stops future collection and use decisions; contact us if you want an already published story reviewed or removed.
You may not record, screenshot, publish, or share another user’s image, voice, name, profile, words, or personal details outside the app’s explicit recording features unless you have that user’s clear permission.
3 Breaths may collect and use information needed to operate and protect the app, including account details, profile information, community membership, matching preferences, usage activity, reports, flags, moderation notes, user IDs, timestamps, and interaction metadata.
We may use this information to provide the app, investigate reports, enforce these Terms, improve safety systems, prevent abuse, and comply with law.
We treat private feedback, reports, and non-public activity details as confidential. They are not shown in ordinary member views or the community feed unless you choose to share something publicly. Authorized administrators, team members, and trusted service providers may access or process this information only as reasonably needed to operate and protect the app, investigate safety concerns, or comply with law.
We may use aggregated or de-identified usage patterns to understand how 3 Breaths is used and to improve the experience. When we report or share those patterns, we will not do so in a form that personally identifies you. This does not limit the use of content you choose to make public or optional recordings and testimonials you expressly permit us to use.
Where applicable law requires consent to collect or share consumer health data, we request that consent separately from these Terms. The request will identify the data involved, the purpose, who may receive it, and how to withdraw permission or request deletion.
These Terms summarize current safety practices. Our separate Privacy Policy explains our current data practices, retention, processors, and privacy choices.
We do not guarantee that 3 Breaths will always be available, secure, error-free, or that a match will be available when you want one. We may change, pause, remove, limit, or discontinue any feature at any time.
We may suspend or terminate your access if we believe you violated these Terms, created risk for other users, misused the app, acted inconsistently with the purpose of 3 Breaths, or created legal, safety, or reputational risk for the app.
You may stop using the app at any time.
3 Breaths is provided “as is” and “as available.” We do not guarantee any particular emotional, mental, physical, spiritual, relational, social, or health outcome.
You are responsible for deciding whether and how to participate in any interaction.
To the fullest extent allowed by law, 3 Breaths and its owners, operators, team members, contractors, partners, and affiliates are not liable for indirect, incidental, consequential, special, punitive, emotional distress, or reputational damages arising from use of the app or interactions with other users.
To the fullest extent allowed by law, our total liability for any claim will be limited to the amount you paid to use 3 Breaths in the previous three months, or $100, whichever is greater. Some jurisdictions do not allow certain limitations, so some limits may not apply.
You agree to protect and hold harmless 3 Breaths and its owners, operators, team members, contractors, partners, and affiliates from claims, losses, liabilities, damages, costs, or expenses arising from your use of the app, your content, your conduct, or your violation of these Terms.
We may update these Terms from time to time. If changes are material, we will make reasonable efforts to notify users. Continued use of the app after changes means you accept the updated Terms.
